1. Scope of Application
These General Terms and Conditions apply to all orders placed via our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (§ 13 German Civil Code).

An entrepreneur is a natural or legal person or a legally capable partnership who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity (§ 14 German Civil Code).

With regard to entrepreneurs, these Terms and Conditions shall also apply to future business relationships without the need for renewed reference. Deviating or supplementary terms and conditions of the entrepreneur shall only become part of the contract if we have expressly agreed to their validity in writing.

2. Contractual Partner, Conclusion of Contract
The purchase contract is concluded with Stamnitz Automotive GmbH.

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an order. By clicking the order button, you submit a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order does not constitute acceptance of the contract. The contract is only concluded upon our express order confirmation or dispatch of the goods.

3. Contract Language, Storage of Contract Text
The language available for the conclusion of the contract is German.

The contract text is not stored by us. These Terms and Conditions can be viewed at any time on this page.

4. Delivery Conditions
Shipping costs may be added to the stated product prices. Further details can be found in the respective offers.

Self-collection is possible by prior arrangement. We do not deliver to parcel stations.

5. Payment
The following payment methods are generally available in our shop:

Advance Payment
If advance payment is selected, we will provide our bank details in a separate email. Delivery will be made after receipt of payment.

Credit Card
By submitting your order, you provide us with your credit card details. The charge will be made after completion of the order.

PayPal
During the ordering process, you will be redirected to PayPal’s website. After confirming the payment instruction, the transaction will be carried out.

Cash Payment upon Collection
If you collect the goods yourself, payment is to be made in cash.

6. Transport Damage
For consumers:
If goods are delivered with obvious transport damage, please report such damage to the delivery agent immediately and contact us without delay. Failure to do so does not affect your statutory warranty rights.

For entrepreneurs:
The risk of accidental loss or deterioration of the goods passes to the entrepreneur upon handover to the shipping service provider. The inspection and notification obligations pursuant to § 377 German Commercial Code apply.

7. Warranty

7.1 Consumers
Consumers are entitled to the statutory warranty rights. For used goods, the limitation period for warranty claims is one year from delivery.

7.2 Entrepreneurs
The following provisions apply to entrepreneurs:

  • Warranty claims are excluded unless liability is mandatory, in particular in cases of fraudulent concealment, assumption of a guarantee, or injury to life, body, or health.
  • Information on vehicle compatibility or usability serves solely as a description and does not constitute a guarantee or agreed quality. The entrepreneur is obliged to verify suitability for the specific vehicle and intended use prior to installation.
  • Liability for installation and removal costs, dismantling, reinstallation, and other ancillary costs is excluded.
  • Liability for indirect damages, consequential damages, and damage to other components or vehicles is excluded.
  • The entrepreneur must inspect the goods immediately and notify any obvious defects within 7 calendar days of delivery and hidden defects within 7 calendar days of discovery in writing. Failure to do so shall result in approval of the goods.
  • Any remaining warranty claims shall become time-barred 12 months after the transfer of risk.

8. Liability

The installation and use of the delivered products is at the buyer’s own responsibility. Entrepreneurs are expected to have installation carried out by qualified personnel.

We shall be liable without limitation in cases of intent, gross negligence, injury to life, body or health, and under the Product Liability Act.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations and limited to the foreseeable, typical damage.

All other liability is excluded.

9. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR). We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final Provisions
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is our registered office.
